Terms and Agreements
This contract is between Complete Calibrations LLC and (Hereinafter “Auto Glass Company”) In consideration of the mutual agreements herein contained, both parties agree to the following:
Complete Calibrations LLC will provide ADAS services to customers (such as Static, Dynamic, and Dual Calibrations), referred by the Auto Glass Company, after their windshield replacement has been completed. It is agreed that Complete Calibrations LLC is given permission to operate the vehicle on streets, highways, or elsewhere for the purpose of testing, calibrating, and/or inspecting vehicle ADAS functionality. Complete Calibrations is not responsible for loss or damage to vehicle or for articles left / lost in the vehicle in case of fire, theft, or any other cause, including all matters beyond our control. Auto Glass Company releases Complete Calibrations LLC from any and all liability for the above listed issues should they arise. After calibration has been completed, if any vehicle prompts alerts which concern ADAS, the customer must call Complete Calibrations LLC at 602.812.2327 to have issues resolved as soon as possible.
Complete Calibrations LLC will invoice the Auto Glass Company once the calibration is complete. The Auto Glass Company is responsible for invoicing the insurance company whom the customer is registered with and receiving payment. If the customer requests a cash paying job without insurance, the Auto Glass Company is responsible for collecting payment/fees from the customer and paying Complete Calibrations LLC the amount invoiced for the work completed.
Should the need for a same day emergency calibration occur, an additional fee of $25 will be applied to the invoice.
In the unlikely event of a calibration failure, due to no fault of our own, (not limited to but including, a defective windshield, broken parts/glass, no camera, no-show customer, etc...) Complete Calibrations LLC will charge a $30 trip charge and inform the Auto Glass company of next step procedures. If the calibration fails due to lack of knowledge/calibration equipment, the Auto Glass Company will not be charged.
Warranties
Complete Calibrations LLC provides a Lifetime workmanship warranty per Job. If the original customer needs a subsequent windshield replacement (R&R) and/or needs a second recalibration for their safety features for reasons not caused by Complete Calibrations LLC, we will provide them that calibration service for a $30 trip charge. Complete Calibrations LLC will not charge a second calibration fee in this specific circumstance.
Payment Invoicing and Late Fees
The Auto Glass Company will be responsible for paying Complete Calibrations LLC immediately upon receipt of the invoice from Complete Calibrations LLC. If payment is not received within 7 calendar days, it is agreed that Auto Glass Company will pay a late fee of $25. Another late fee of $25 will be added every 30 calendar days if the invoice goes unpaid. There are no exceptions to this policy.
Termination of the Agreement
If Auto Glass Company wishes to terminate this agreement, or they decide to no longer use Complete Calibrations LLC for calibration services, Auto Glass Company agrees to give Complete Calibrations LLC, two weeks notice upon terminating this ongoing agreement. Furthermore, if the Auto Glass Company chooses to breach any agreement, then Complete Calibrations LLC has the option to terminate this agreement immediately without notice.
Additional Agreements
It is agreed that this written agreement contains all agreements made and that there are no other agreements agreed to absent a written document signed by both parties.
Applicable Law and Remedies
This contract is governed by the law of Arizona, and the parties agree that should a conflict arise, prior to filing any civil action, there is an agreement that the parties will participate in mandatory arbitration proceedings and that they will accept the determination of the arbitrator in that instance.
Notice
This agreement, and the wording herein, is subject to change anytime at the discretion of Complete Calibrations LLC.
